📜 Reference legal text — Legislación consolidada. Article 82

Liability for violations of the provisions of this law shall fall directly on the perpetrator of the act in which the violation consists. However:

  • The driver of any vehicle for which the use of helmets is required by both the driver and passenger shall be responsible for the failure of the passenger to wear a protective helmet, as well as for transporting passengers who do not meet the minimum required age.

Likewise, the driver of the vehicle will be responsible for the non-use of child restraint systems, with the exception provided for in Article 13.4 in the case of professional drivers.

  • When the authorship of the acts committed corresponds to a minor under eighteen years of age, his or her parents, tutors, foster parents and legal or de facto guardians, in that order, shall be jointly liable with him or her for the fine imposed due to the failure to comply with the obligation imposed on them which entails a duty to prevent the administrative infraction charged to the minors.
  • In cases where the vehicle is not detained and has a designated regular driver, liability will fall on the driver, unless it is proven that the driver was another or that the vehicle was stolen.
  • In cases where the vehicle is not detained and there is no designated regular driver, the driver identified by the owner or long-term lessee will be responsible, in accordance with the obligations imposed in Article 11.
  • In short-term vehicle rental companies, the lessee shall be responsible for the vehicle. If the lessee claims not to be the driver, or is a legal entity, they shall be subject to the obligations established for the owner in Article 11. The same liability shall apply to owners of mechanical workshops or vehicle sales establishments for violations committed with vehicles while they are parked there.
  • The owner, or the long-term lessee, in the event that it is registered in the Vehicle Registry of the autonomous body Central Traffic Headquarters, will in all cases be responsible for violations relating to the vehicle's documentation, periodic inspections and its state of conservation, when the deficiencies affect the safety conditions of the vehicle.
  • The owner or lessee, if registered in the Vehicle Registry of the autonomous body Central Traffic Headquarters, shall be liable for parking violations or non-payment of tolls on roads that regulate this, except in cases where the vehicle has a designated regular driver or a responsible driver is indicated.
