The amount of the fines established in article 80.1 and in annex IV may be increased by 30 percent, taking into account the seriousness and significance of the act, the offender's previous record and his/her status as a repeat offender, the potential danger created for himself/herself and for other road users, and the criterion of proportionality.

The grading criteria established above shall also apply to the sanctions for the violations provided for in Article 77, paragraphs n) to (inclusive).
