In short, the rule makes sure every road user knows what to expect in this situation.
These are specific rules that round off the theory; read them closely, as the nuance often decides the correct answer.
Processing of authorization applications.
The procedure for requesting authorization for sports events from the corresponding government authority will be as follows:
- Competencies.
The authority to issue the authorization to hold a sporting event will correspond to:
- To the autonomous body Central Traffic Headquarters, when the route of the test takes place on roads in more than one autonomous community.
- To the corresponding autonomous community and the cities of Ceuta and Melilla, when the test is carried out entirely on roads located within their territorial scope.
- To the city council, when the test takes place entirely within the urban area, excluding crossings.
- Reports.
- From the owner of the route: the bodies that own the routes along which the sporting events will take place will issue a report on their viability.
- From the autonomous body, the Central Traffic Headquarters: when the authority to authorize the tests is assigned to an autonomous community, it will request a report from the Traffic Headquarters of the provinces through whose territory they pass. If the authority is assigned to the cities of Ceuta or Melilla, they will request a report from the Local Traffic Headquarters, provided that traffic surveillance and regulation is assigned to the General State Administration. In the autonomous communities that have been transferred the authority to implement traffic surveillance, the report will be requested from the body exercising that authority. The reports will determine the surveillance services.
- The reports provided for in paragraphs a) and b) shall be binding when they oppose the performance of the sporting event or make it conditional on compliance with certain technical requirements.
- Documentation.
The application for special authorization to hold sporting events must be submitted to the competent authority at least 30 days in advance, accompanied by the following documents:
- Organization permit issued by the corresponding sports federation, when required by sports legislation.
- Test report in which the following will be recorded:
- Name of the activity and, where applicable, chronological number of the edition.
- Test regulations.
- Precise sketch of the route, date of the event, itinerary, profile, probable time of passage through the different determining points of the route and expected average speed for both the head of the race and its closing.
- Identification of the organization's managers, specifically the executive director and the road safety officer, who will direct the activities of the authorized auxiliary personnel.
- Approximate number of expected participants.
- Proposal of signaling measures for the test and the rest of the safety devices planned in potential dangerous locations, as well as the role to be performed by authorized auxiliary personnel, all through a detailed report that will be communicated in due course by the person responsible for road safety during the test or by law enforcement to the personnel responsible for monitoring these conflict areas.
The road safety officer responsible for the test must be familiar with traffic regulations and must have a valid driver's license.
The competent authorities will draft specific instructions containing basic notions on traffic regulations, the contents of which will be mandatory for the road safety officer responsible for the test.
- Proof of having taken out the civil liability and accident insurance referred to in Article 14 of this Annex.
- Resolution.
The competent authority will issue and notify the decision within 10 business days of the application being submitted. If this period elapses without a decision being issued, the permit for organizing the event will be deemed granted. The decision may be appealed as appropriate. The decision will determine the surveillance services, the cost of which will be borne by the event organizers.
