Obligations of the driver

Obligations of the driver is one of the topics in the Driving maneuvers block of the Spanish DGT theory. Overtaking, changes of direction, stopping, parking, lighting and warnings. Understanding this section well helps you answer the theory-exam questions on this topic with confidence.

In simple terms, this point of the DGT theory establishes that the driver being overtaken is prohibited from increasing speed or performing maneuvers that obstruct or hinder the overtaking process. They are also required to reduce speed if, after the overtaking maneuver has begun, a situation arises that poses a danger to their own vehicle, the overtaking vehicle, oncoming traffic, or any other road user.

Manoeuvres are tested with practical cases; remember the correct order: observe, signal and only then carry out the manoeuvre.

📜 Reference legal text — Article 86 (2)

The driver being overtaken is prohibited from increasing speed or performing maneuvers that obstruct or hinder the overtaking process.

They are also required to reduce speed if, after the overtaking maneuver has begun, a situation arises that poses a danger to their own vehicle, the overtaking vehicle, oncoming traffic, or any other road user.

However, if the overtaking driver clearly shows they are abandoning the maneuver by reducing speed, the driver being overtaken is not required to slow down if doing so would endanger road safety. However, they must allow the overtaking driver to return to their lane safely.
